Invoicing Payment Terms
By using our invoicing system, you agree to our standard terms, including timely payment by the due date on the invoice. To maintain our 24-hour delivery guarantee, all clients must have a clear account balance to book new services. Invoices will fall due the day before the service is scheduled. If payment is not received, images will not be delivered. For repeated breaches of payment terms, further bookings may be paused or the ability to pay by invoice may be revoked until any outstanding invoices are settled.
Overdue invoices will incur a 10% administration fee after 7 days and will accrue every 7 days thereafter. Collections will be contracted after 30 days and any fees associated with employing collections services will be added.

Real Estate Photography General Terms
All images are provided under a Digital Image license.
We do NOT provide RAW unedited files to clients.
We aim to deliver most real estate images within 24 hours under normal circumstances. If there will be any delays to this timeframe we will let you know.
Photography is carried out on properties as they are presented. We are not responsible for cleaning or staging a property unless that service has specifically been selected. For suggestions on preparation click HERE
The included number of images may vary depending on the property type. Please carefully select which booking is appropriate for your listing. If your property is larger than 5 bedrooms or consists of multiple structures please select the 90 minute service as opposed to our standard 45 minute pack ensure you get full coverage. Aerial images are included in some packages however drone images are subject to strict safety rules and may not always be safe to operate. In this case additional interior/exterior images will be provided where possible.
If a property is not accessible on the day of booking a $40 rescheduling fee will be charged. Cancellations within 24hrs of the scheduled booking will attract a 50% cancellation fee to cover time lost.

Real Estate Photography (Copyright & licensing)
Images provided by That Emerald Photographer are protected under Australian Copyright Law. Images supplied by That Emerald Photographer are provided as a third party service under a temporary license to assist in selling a home and are NOT to be sold or transferred as part of a property sale contract. Images are not provided as a product to own. When booking our sessions you are booking our service, which includes attendance, capturing images, image editing, image delivery and specific use rights. That Emerald Photographer owns the images and retains the right to use any images captured for any session in the promotion of services we provide. As the Copyright holder we also reserve the right to resell, distribute and license any images captured to third parties if and when we choose at our discretion. By choosing That Emerald Photographer you are agreeing to these terms. Agents are not permitted to re-use, sub-license, resell or re-distribute images outside the scope for which the images were originally provided, including using the images for commercial purposes such as AirBnB, Hotel/Accommodation advertising, permanent website display by the agent, vendor or third party. Agents/vendors are not permitted to transfer images or licenses to third parties for any purpose once the property has been sold. Additional licensing may be purchased to re-use images under new property owners or new agency listings. When a listing is sold, unless a new licensing agreement has been purchased, the permitted use of the supplied images hill expire and any stored copies must be destroyed. Breaches of these terms will result in copyright claims being made, takedown notices being issued and legal remedy being sought under Australian Copyright Law.

Residential Floor Plans
Floor plans are provided for the main residential premises only. External spaces. Sheds, workshops, granny flats etc can be added on at an additional fee. Please discuss with your photographer prior to the session.

General Copyright & Licensing (commercial)
All images are subject to a signed commercial icense agreement and commercial license fee.
That Emerald Photographer retains the right to use any images captured for any session in the promotion of services we conduct. As the Copyright holder we also reserve the right to resell, distribute and license any images captured to third parties if and when we choose at our discretion. By choosing That Emerald Photographer you are agreeing to these terms.

Refunds
No refunds are provided for digital images once the service is carried out and delivered. Refunds for cancelled bookings can be provided up to 24hrs before the session less a 20% cancellation fee (or deposit paid). Cancellations within 24 hours attract a 50% cancellation fee. For larger bookings and commercial services a non-refundable booking deposit is required. Half-day deposit is 20%. Full-day is 25%.

Deposits for Events/Corporate
No booking is secured unless the required deposit or payment terms have been met. Unpaid invoice reminders will be sent via email prior to the booking. If no payment has been received by the specified time the booking reservation will be cancelled and we will not be present for the event.

Rain Delays
In the event of a rain event that necessitates rescheduling your session, you can easily move it to the next available time slot at no additional cost. Should you still wish for us to attend your location to capture “what we can” during the wet weather please note that certain components of your session may not be possible due to safety and electrical hazards, including aerial photography and external images.
As such, any images we cannot safely capture will be forfeited, and only the material captured on the day will be provided. No refunds will be offered for any material that cannot be captured due to these constraints. If you request us to return to capture aerial and external imaging despite these limitations, additional fees will apply to cover the extra time incurred.
